The water supply industry is vitally important not only to maintain the health of the community but for the sustainability of industry, business and agriculture2 in this case, the SPAN Suruhanjaya Perkhidmatan Air Negara.

The politics of water is one of the sub-topics for the water management which involves the management and politically contested water resources use3. The water politics is mostly focus on the intervention of authority and the water resources.

The politics of water always reform when the human interaction involved. The importance water management can be mentioned that it crucial in reforming and controlling the regulation and use of water resources for the public, and industrial used. Thus, the politics of water is defined the importance of water management. In this case, SPAN is the coordination of all the water management course and regulations; the policy used by SPAN enable the smaller unit especially the local governance to take a better and organized action in keeping the water quality on its excellent level.

Picture 1. The nickname for the name is SPAN represent an organization that is competent and efficient towards the regulation and monitoring the water service. The dark blue colour represents SPAN to become as a monitoring agency which will monitor the water industry holistically. The wave sketch on the logo itself, represent that SPAN is ready to face the challenge in the future in order to increase the quality of the water industry for the sake of users and the nature.

The two blue wave representing safe and clean of water supply and the exertion of treated sewage waste product. The green wave represent that SPAN is committed in preserving the nature.

To achieve that vision, SPAN have a mission which is to regulate and monitor the water service industry through the implementation of Water Service Industry Act with fair, effective, and permeable. For the restructuring of the SPAN, the Government has implement two act which has been debated and approved by the Parliament.

It also remarks the beginning of the road towards success for SPAN in increasing the water service industry and the sewage system. Meanwhile the elected member are excellent in their own portfolio which each self were from the professional field from various discipline involving the technical field, public administration, accounting, legislation, consumerisation, and research.

The first task for the SPAN is to search competent and reliable task force and to form an organization. For the existence of SPAN, it being implement on the coordination of the Water Department in each and every state within Malaysia, which means that it responsible in avoiding every system in the Water Department to be colliding with each other and also to collide with the other Government Department as well.

There is several function of the SPAN 4; 1. To advise the Minister on all matters in relation to the national policy objectives of the water supply and sewerage services laws and to implement and promote the national policy objectives.

To implement and enforce the water supply and sewerage services laws and to consider and recommend reforms to the water supply and sewerage services laws. To ensure the productivity of the water supply and sewerage services industry and the monitoring of operator compliance with stipulated services standards, contractual obligations and relevant laws and guidelines.

To increase concerted efforts towards improving the operational efficiency of the industry and in particular the reduction of non-revenue water through short-term, medium-term and long-term programmes. To advise the Minister on a fair and efficient mechanism for the determination of tariffs that is fair to both consumers and licensees and to implement tariffs that have been establish through appropriate mechanism and tools.

To ensure the national development goals pertaining to coverage, supply and access to water supply and sewerage services are achieved. To ensure long-term sustainability of quality of water and sewerage services through continued capital works development. To formulate and implement a plan so that all reasonable demands for sewerage services are satisfied and in consultation with the relevant authorities, prepare a sewerage catchment plan formulating the policy and general proposals in respect of the development of any new sewerage system and measures for improvement of any existing sewerage system.

To carry out any function conferred upon it under any other law. To advise Minister generally on matters relating to water supply services and sewerage services. For the overall of the SPAN functions, they responsible in improving the efficiency of the water supply, the irrigation and sewage system.

They also responsible in coordinating the system they had parallel with the Government system in order to be not colliding with the national policy and the vision and mission of SPAN. SPAN also responsible in keeping the national goal on water resource, sewage and water system in a fully maintained and at a satisfactory level.

The national goal towards the water supply and sewage service industry are as follow5; 1. To form one sewage and water supply service structure that is permeable and solid in order to provide an effective and efficient service to the users. To make sure the available water resource is available and continuous for a long period of time including the effort in preserving the water supply.

To preserve the available water catchment area and the available natural water bodies and reservoirs. To allow healthy competition for the tendency of the economic growth and efficiency in the water supply service industry and sewage services. To form a monitoring and regulation atmosphere which allow the financial capability state in solid form between the water service industries and the sewage services for a long period of time. Monitoring for the sake of the users interest for long period of time.

Monitor the tariff and making sure the service availability are on the satisfactory level on the equity fundamental. Increase the life quality and the surrounding through effective and efficient management on water services and sewage services. To organize one reliable system and the monitoring and regulation system between the provider of water services and sewage services.

Monitor the safe atmosphere and the security of the water services and sewage services. As the SPAN national objective, they also facing some problem which relating the lack of coordination of the involve authority, ineffective monitor and regulation structure, weak implementation, limited fund source and the different achievement level by the project of water service by the private sector.

Thus, the challenge face by SPAN is to make sure a structure for the new industry through realization and able to provide a holistic approach in the term of water service industry management also able to fulfilled these following aspiration; 1. Provide a solution towards various problems in the field and to form an effective and permeable administration system. Exert license and monitoring and regulating the entire water service provider including the private sector.

Encourage efficiency and providing competition through comparison and minimum qualification which became the basic fundamental for increasing the service quality. Assuring the users are well-protected through well provide quality by fair and square with affordable charge and the provider also can have a commercial environment towards effective water service industry management.

Encourage the public involvement holistically in handling various issues of policy and regulation through the Water Forum Forum Air. This will make the user become aware and know their right; also it can increase the efficiency of the service provider.

These three dimensional aspect is the fundamentals aspect to be used as the measurement for the effectiveness of SPAN. Within the politics dimension, it involved the policy whether it is the SPAN policy, national policy and Local policy. In the economy dimension, it involved the business proposal of the SPAN, the other agency which had collaborated with the SPAN, also the statistical data of the revenue of the water consumption whether domestically or non-domestically.

In the dimension of social, it just involves the management of human resources, and the facilities that had been given to the users. This is because, the community in a nation is a developer and consumer, hence the polluter, which is eventually became the social cause of pollution for the water system.

Living and production to sustain living both produce waste8 which will eventually affecting their life if the policy or the implementation in the politics dimension is weak and fragile. The weak and fragile legislative system will affecting the SPAN al well, and it is concerning the responsibility, reliability and trust on an organization in managing water resources. SPAN had made a several commitment which is include attitude, professionalism, partnership, sustainability, innovation, and efficiency9.

Commitment on attitude means the responsibility as the individual and as a team towards every action, attitude, and revenue of the task done. The honesty, permeable, and ethically were practically use in every interaction. This attitude is to make the task done is done with an excellent result. Commitment for the professionalism means that every task done is proof-based job.

Method will be implemented directly and consistence also the decision is legislative-based, public opinion, science-based and fiscal responsibility. Meanwhile, the partnership commitment is just based on respect that each and every worker got based on their professionalism and competency also committed to solidify and to enhance the collaboration; to support the firm development for the water service industry and sewage system.

Commitment towards innovation means that every method taken and every step face will be parallel with the innovation for improvement. Improvement is crucial just to make sure that SPAN is able to comprehend the current situation. Commitment towards efficiency means that the source will be in an optimize condition and use wisely. Effort will be executed by strategies which will eventually resulting in the efficient of the water service, and to provide a performance indicator for an excellent service by the entire water provider.

SPAN Act has 44 sections which divided into six parts. The SPAN Act obviously ensures SPAN existence is to monitor and regulate the water industry service also implement the laws regarding the water and sewage industry service.

Part I which include the section 1 until 2 stating that any issue or matter from the beginning, implementation of the Act and the definition for the words used in the Act. Part II which include section 3 until 4 are regarding the establishment of Commission and give the authority to the Commission to establish department in helping the Commission. Part III which consist section 15 until 19, clarify on the function and the authority given to the Commission including giving the obligation towards the other Commission to give statement, report, account and any information to the Ministry or any authority.

Part IV which consist of section 20 until 26 which focusing on the staff of Commission including the appropriation for the election and the term and condition for the service for the staff also allowing Commission to accept and use the regulation and rules given out by the State Government regarding any issue that related to the Commission staff. Part VI consist of section 38 until 44, which consist general appropriation such as stating the members, staffs, and agent of Commission as the general service staff and give Commission an authority to elect technical adviser service and other consultant.

Among the main objective IPA Act is to form a task framework to enhance regulatory on the water supply service industry and sewage service parallel to the National Goal. However, any subsidiary laws that made under the Act, which is consistent with the IPA Act still be ongoing until it been terminated or replaced with other subsidiary laws which legislate under the IPA Act. IPA Act has sections which divided into 13 sections.

Appropriation of the framework is as follows; 1. Part I which consist section 1 until 3 clarify the appropriation for enforcement and implementation for the Act, definition of a few expression that used in the Act and appropriation which exert executive authority to the State Government regarding the issue about the water supply and sewage system and water supply and sewage service.

Part II consist section 4 until 28 which clarify the need for the license. There is two types of license individual license and class license; individual license are given by the Ministry under the Commission advice. Meanwhile, class license obtained through registration which needs to be approved by the Ministry according to the general criteria given.
